Terms of Service

These Terms of Service ("Terms") govern your use of the KiboDaily app and website (the "Service") provided by KiboDaily (trading as KiboDaily, "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

KiboDaily is a personal wellness app for tracking water intake, sleep, reminders and related habits. It is intended for general wellness use only and is not a medical device and does not provide medical advice, diagnosis or treatment.

2. Eligibility & account

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

3. Acceptable use

You agree not to:

  • use the Service unlawfully, fraudulently, or to harass others;
  • infringe anyone's intellectual property or privacy rights;
  • attempt to interfere with the Service's security, scrape it, probe it for vulnerabilities, or distribute malware;
  • reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
  • resell, redistribute or commercially exploit the Service without our written permission.

4. Subscriptions, billing & refunds

Some features ("Premium") require a paid subscription. Plans, prices and any free trial are shown on our pricing page before checkout. Unless stated otherwise, subscriptions renew automatically at the end of each billing cycle (monthly or yearly) at the then-current price, until cancelled.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refunds are governed by Paddle's Buyer Terms.

You can cancel your subscription at any time from the billing portal accessible inside the app. Refund requests are handled per our Refund Policy via paddle.net.

5. Intellectual property

The Service, including all software, designs, text, graphics, theKiboDaily name and logo, and all related intellectual property rights, is owned by KiboDaily and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial wellness tracking, in accordance with these Terms. You retain ownership of the data and content you enter and grant us a limited licence to host and process it solely to provide the Service.

6. Service availability & disclaimers

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Wellness information shown by the Service is general guidance only and is not a substitute for professional medical advice.

7. Limitation of liability

To the maximum extent permitted by law, KiboDaily will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or in connection with the Service is limited to the amounts you paid us in the 12 months before the event giving rise to liability. Nothing in these Terms excludes liability that cannot legally be excluded (e.g. fraud, death or personal injury caused by negligence).

8. Suspension & termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, pose a security or fraud risk, or repeatedly violate our policies or applicable law. You can close your account at any time from the Profile screen. On termination, your right to use the Service ends; we will delete or anonymise your data as described in our Privacy Notice.

9. Changes to the Service or Terms

We may update the Service and these Terms from time to time. If changes are material, we will give reasonable notice. Continued use of the Service after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the seller's place of establishment, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where mandatory consumer law gives you the right to bring claims in your country of residence.
